Welcome to Feedback Footprint, LLC. These Terms and Conditions (“Terms”) govern your use of our website (https://feedbackfootprint.com) and the services we provide, including SMS automation, review request systems, feedback collection, and related tools (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.


1. Eligibility and Business Use Only

Our Services are intended for use by businesses only. By using our Services, you confirm that you are authorized to act on behalf of a business or legal entity and that you are not using the platform for personal or consumer purposes.


2. Description of Services

Feedback Footprint offers tools and automation for businesses to:

Send automated review requests to their customers via SMS and/or email

Collect internal and public feedback using smart review filtering

Optionally post positive reviews to social media or review platforms

Track customer sentiment and campaign performance through analytics

Integrate with CRMs and platforms via tools like GoHighLevel, Zapier, and others

The scale and features of the Services vary based on the subscription plan selected by each client.


3. SMS Messaging and Compliance

By using our Services, you understand and agree to the following:

Only contacts who have provided prior, documented, and verifiable consent may receive SMS messages through our platform.

Clients are solely responsible for the content of the messages sent through their account.

All SMS campaigns must include clear identification of the sending business and provide recipients with the ability to opt out by replying “STOP.”

Message and data rates may apply. Feedback Footprint is not responsible for carrier fees.

Clients must comply with all applicable federal, state, and local laws, including but not limited to the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, CTIA guidelines, and any relevant carrier policies.

Failure to follow messaging regulations may result in suspension or termination of your account without refund.


4. Client Responsibilities

By using the Services, you agree that:

You are solely responsible for obtaining consent from your customers before sending them messages via SMS or email.

You will not upload or share contact information that you do not have permission to use.

You will not send messages that are misleading, abusive, illegal, or spammy in nature.

You will comply with all applicable laws and regulations concerning marketing communications and consumer data.


5. Account and Billing

You agree to provide accurate and up-to-date billing and account information. Subscriptions renew automatically unless canceled prior to the billing date. All payments are non-refundable unless otherwise stated in writing. We reserve the right to modify or discontinue any feature of the Services at any time.


6. Data Privacy and Use

All data collected through the Services is handled in accordance with our Privacy Policy. We do not sell your data or your customers' data.

As a service provider, we process customer data only as instructed by our clients and solely for the purpose of delivering our Services. We may share data with trusted third-party providers (e.g., GoHighLevel, Stripe, Zapier) solely for service fulfillment.


7. Smart Review Filtering & Feedback Flow

Clients may choose to enable a feature that routes customer responses based on sentiment:

Positive feedback: Customers may be directed to public review sites such as Google.

Neutral or negative feedback: Customers may be directed to an internal feedback form.

In all cases, customers are still offered the choice to post their feedback publicly.

This system is designed to improve client responsiveness while ensuring transparency.


8. Intellectual Property

All content, trademarks, logos, and intellectual property associated with the Services remain the property of Feedback Footprint, LLC. You may not copy, reproduce, or distribute any part of our platform or materials without prior written consent.


9. Termination

We reserve the right to suspend or terminate your access to the Services at any time for violations of these Terms or applicable laws, or for non-payment.


10. Disclaimers and Limitations of Liability

The Services are provided “as is” and “as available.” We do not guarantee that the Services will be uninterrupted or error-free. In no event shall Feedback Footprint, LLC be liable for any indirect, incidental, or consequential damages arising out of or related to your use of the Services.


11. Modifications to Terms

We may update these Terms at any time. Updates will be posted on this page with a new Effective Date. Your continued use of the Services constitutes acceptance of the revised Terms.


12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
